- Company sues CBS and Apple over 'Mighty Mouse' name

A firm named Man and Machine is suing both Apple and CBS for trademark infringement for using the Mighty Mouse name to describe a computer input device. Man and Machine makes hygenic water- and chemical-resistant keyboards and mice for hospitals and laboratories.
Man and Machine claims CBS (who owns the cartoon property, which may or may not be pictured) did not have the legal authority to license the name to Apple. Man and Machine holds a trademark for use of the Mighty Mouse name in conjunction with an interface controller. It claims it first used the term in 2004, but only filed for the trademark in December 2007. CBS's trademark (which covers Apple's device) was filed in July 2007, indicating its first use was in 2005 (when the Mighty Mouse came out).
Thus the tension. It's unclear if Man and Machine licensed the Mighty Mouse name (as Apple did) and whether or not that will influence the outcome.

Apple's iPhone-based AppStore is sure to debut sometime in the next month or two. My guess is that it will launch at WWDC, with select close partners at the launch and then a general opening to the rest of the third-party developers. I'd be quite surprised if AppStore launched and allowed immediate access to everyone who wanted to post an application for sale.

Just over a month after its 1.6 release, the Camino team has just released version 1.6.1. As Camino's own page states, "Camino 1.6.1 is a stability and security update . . . All users are urged to upgrade."
Camino should now be less crash-friendly and nitpicky about search engine additions and compatibility with Dreamweaver and other programs using deprecated AppleEvent has been restored.
1Password caused a "possibly incompatible" message to appear, although I haven't had any password or keychain related issues since installing 1.6.1, so keep that in mind if you use both.

Are you looking for a tiny portable hard drive for doing Time Machine backups on the road? I do a lot of traveling with my MacBook Air and don't often get a chance to back it up to the 1 TB monster at home. Although there are several other diminutive hard drives on the market, when I saw the My Passport Studio line of portable drives announced today by Western Digital, I ordered one. After all, the case matches my AirBook!
Available in 160 ($129.99), 250 ($189.99), and 320 GB ($219.99) flavors, My Passport Studio drives are about 3.2" x 5.0" x .71" (81mm x 127 mm x 18 mm) in size and weigh a featherweight 6.4 ounces (.18 kg). The drives are bus powered -- USB 2.0 or FireWire 400 -- so there's no need to tote a power brick when you're traveling. They're formatted as HFS+ Journaled, requiring Mac OS X 10.4.11+ or 10.5.2+.
The drives are available from Western Digital, and through a variety of online and brick-and-mortar stores. The 250 and 320 GB drives are showing back-order status.

Переслать - 10.5.2 causing mega-problems for musicians?

Peter Kirn over at Create Digital Music (one of my favorite music-making blogs, by the by) has a post rounding up a lot of the issues OS 10.5.2 seems to be having with various drivers for audio interfaces, including those manufactured by Digidesign (aka the Pro Tools folks) and its subsidiary M-Audio. This is a pretty big problem, as Digidesign and M-Audio are two of the most popular manufacturers of prosumer/professional audio interfaces. Peter's post links to apologies and explanations from the manufacturers as well.
According to Dave Lebolt, general manager at Digidesign, the 10.5.2 upgrade may have actually broken fixes that appeared in 10.5.1. And Kirn goes as far to say that he "certainly can't recommend Leopard in its current state," at least for making music, which is why I haven't upgraded from TIger myself.
Does this affect you if you're not a music geek? Probably not. But when your psycho microhouse-obsessed beatmaking roommate starts swearing and kicking his MacBook and ProTools rig around in the middle of the night, at least you'll know what the fuss is all about.Read | Permalink | Email this | Comments

Attention all bloggers! The nerd bunnies at Brainjuice have just released Blogo 1.1, the latest take on their Mac OS X blogging tool. Blogo 1.1 now includes support for Drupal and Twitter in addition to WordPress, Blogger, TypePad, typo, and MovableType.
The new Twitter support allows users to post tweets and direct messages from Blogo, and can even send a tweet whenever you post. Brainjuice has fixed some existing issues, as well as adding these new features:
- Support for raw image formats
- Integration with NetNewsWire and Safari
- Use of Growl for all user notifications
- New text formatting options (quotes, lists, aligned, justified)
- Custom cropping of thumbnails independently of the full-size images

Hot the heels of Apple's recent double D&AD Black Pencil victory for excellent design the British newspaper the Independent interviewed Jonathan Ive, Apple's senior vice-president of industrial design and now holder of a record six Black Pencils. There's a charming sense of British lad made good about the piece, and it's always interesting to learn about how Ive approaches his craft.
He says that his "goal is simply to try to make products that really are meaningful to people. Ultimately there is something motivating and inspiring in seeing someone using an Apple product and enjoying an Apple product." And fortunately for our favorite fruit company Ive insists that he can't possibly imagine working anywhere but Apple.

Attention Logic Studio users. Apple has released version 8.0.2 of Logic Pro. According to Apple, this update "...addresses specific customer and compatibility issues of Logic Pro 8.0. It includes Wavebuner 1.5.2 and Impulse Response Utility 1.0.2, which address issues for Waveburner 1.5 and Impulse Response Utility 1.0 respectively."
Version 8 of Logic Studio and Express became available in September of last year. If you think that rate of updates is slow, take heart. Apple recently re-affirmed their commitment to the pro applications, most notably Final Cut Server.

Переслать - Napster MP3 store to rival iTunes store with 6 million DRM-free tracks

Napster has announced that it is now offering DRM-free MP3 downloads that play on the iPod family and the iPhone. Furthermore, the library is 6 million songs which puts it in the same league as the iTunes Store, and indeed far eclipses the latter in DRM-free offerings. The MP3s are 256kbps and cost 99 cents per track with "most" MP3 albums at $9.95.
Personally, I had long since moved most of my download music buying to Amazon MP3 to take advantage of the DRM-free offerings (and slightly lower price) versus the iTunes Store. The main disadvantage to Amazon MP3 was the smaller library; now with Napster offering a similar sized library to the iTunes Store it will be interesting to see if and how Apple responds. Indeed it will be interesting to see if Apple is able to respond with more DRM-free music since it seems clear that the record companies are basically triangulating against Cupertino in a bid to undermine Apple's online music dominance.

Earlier this week, we found the story of an Oregon State police officer who was able to retrieve email, photos and other bits of information left by the previous owner of his refurbished iPhone. Granted, he was using special forensics software, but the data was retrievable.
Geeks to the rescue! Securosis offers up a method for ensuring that all personal information gets overwritten. It involves the clever use of playlists, but you'll have to read the whole post to get all the details.
Now, they admit to not testing this method thoroughly, so if any of you iPhone hackers out there want to put it to the test, please tell us what you find!

Most people rarely ever have to rename a whole lot of files at once. Let's face it -- batch file renaming isn't UNIX kernel reprogramming, but it's one of those irritating tasks that can be a surprising amount of trouble for casual or even more experienced users without the right tools. As a web designer and developer, I find myself having to numerically rename images a lot or add "_tb" suffixes for thumbnails, for example.
Luckily for Leopard users, there's Name Mangler 2.0, a donationware app by Mac developer Many Tricks that does all the stuff you might need a batch file renamer to do: change case or extension, prefix or suffix a file name, remove characters, the works. You can even store renaming configurations as droplets that you can drop files or folders on to.
Unfortunately, Name Mangler is Leopard-only. Many Tricks has an earlier app, File List (direct download link), that apparently does the same thing for pre-Leopard systems; another alternative app is File Wrangler, which resides on my 10.4.9-running MacBook Pro quite happily, or the venerable and powerful A Better Finder Rename.

Переслать - Rumor: Simultaneous iPhone 2.0 release for Korea, Japan
3G iPhone rumors are like summer evening mosquitoes: very annoying but also impossible to ignore. Fortune is the most recent buzzing in our ears with a report that the next major iPhone release will include Korea and Japan at the same time.
Specifically, tech news coming from Korea suggests that Apple is in talks with NTT DoCoMo of Japan and Korea's own Telecom Freetel. Both are big players in the 3G market in that part of the world. In fact, NTT DoCoMo is credited with having pioneered 3G mobile phone technology.
Both Korea and Japan are huge markets that Cupertino would certainly love to grab hold of. Of course, this will all be clear in just a few weeks. Most likely.

He's got step-by-step instructions if you want to make your very own very Mario-friendly Front Row / Apple TV controller. Personally, I'd love to leave one of these sitting on my coffee table.

Everyone eventually forgets a password or two. It's OK, don't be ashamed. Even your friends at TUAW have committed this error. Honestly.
Ivan at CreativeBits offers a simple way to reveal a forgotten password with Mac OS X's Keychain Access application. You'll find it in your Utilities folder (which lives in the Applications folder). It lists all the passwords you've stored for different applications (wireless networks, FTP servers, etc.). Just select the one you're interested in and perform a "Get Info" by hitting Command-I. Last night, Apple released a new ad for iTunes featuring Coldplay. This ad takes the silhouette ads to the max with a beautiful Leopard/space-esqe background and Coldplay singing their new song, Viva la Vida. Once again, this ad was featured during an episode of American Idol, which seems to have been a weekly occurrence through the Idol season.

Macworld is reporting that phishers are using the iTunes Store as a way to get personal information, using emails similar to those that purport to be from banks or auction sites.
Andrew Lochart, from security company Proofpoint, Inc., says the emails indicate that users must correct a problem with their iTunes account. The email links to a phony web page asking for the user's credit card number, social security number, and mother's maiden name.
In Macworld's interview, Lochart suggested that iTunes was chosen as an attack method not only because of its popularity, but also because of a young user base that shows "a certain level of trust or openness when their post their name and age and school on MySpace."

When I was a lad in Pennsylvania, renting a movie meant driving to Scranton Video (this is pre-Blockbuster, boys and girls) and crossing your fingers in hopes that something you actually want to watch will be among the four dozen VHS tapes they had in stock. Of course, the previous customer didn't rewind the tape before returning it.
A few years later, Blockbuster provided a much larger collection of unwound movies I didn't want to see. Eventually, Netflix took the inconvenient travel out of the equation (except for us small-town folk with PO Boxes) by sending movies through the mail. And there was much rejoicing.
Today, services like On Demand and Apple TV have eliminated the taxing walk to your mailbox by delivering movies directly to your television. Customers can rent, download and watch a hit movie faster than you can say "sedentary lifestyle." And Netflix wants a piece of the (in)action.
Neflix and Roku have produced the Netflix Player, a $99US set top box that allows Netflix customers to stream any of the 10,000 available movies and TV shows. It connects via HDMI, composite, or component, and allows users to browse the library and make selections with the remote.
At one hundred bucks, it's less expensive than an Apple TV, but it also does a lot less -- no iTunes or iPhoto synchronization, current trailers, etc. It's not a real threat to the Apple TV, but evidence that the set top box is here to say.
