There are days when I wonder if Rob Enderle was put on this earth to amuse Mac bloggers. His latest commentary is proof. I mean, seriously. His latest commentary is proof.
I mean, seriously. What else could convince Enderle that Ruckus, a PlaysForSure media store that doesn't work with the iPod or Zune, will supplant the dominance of iTunes? These aren't arguments based on sales data or market analysis -- they're based on gut. And I have to say, Rob appears to have been born without a large intestine. Six months ago, he probably said Rhapsody would take out iTunes. Before that, Napster. He also thinks the Prada is clearly ahead of the iPhone.But he was just getting warmed up. His craziest comments come from claims Enderle makes comparing some future phone concepts by Philips from 1998 and implying that Apple ripped them off. Yep, including the picture of the butterfly above. It looks just like the iPhone. Not.

There's a lot to love about Enderle's not-so-expert analysis here. For one thing, it seems pretty clear that he doesn't understand the idea of design prototypes -- or theming software.
One of the interesting things that didn't get much coverage was that (given most of the smart phones already on the market have touch screens and will allow you to install 3rd party software) it was only a matter of hours after the iPhone launched that several programmers had released iPhone clone software that would turn a Treo Palm based or Microsoft Mobile based smart phone into something that looked a lot like the iPhone.
Apple's legal team sent out this note to those that did the emulators and most now are much harder to find. However in thinking about prior art, one of the defenses in situations like this is past design concepts and I couldn't help but go back to 1998 when Philips appears to have come up with the idea for the iPhone.Ow. Ow. OW. It hurts my brain so much. Theme software is not an emulator, Rob. Emulators actually run the software of the platform being faked. This was software that put in new icons and ring tones to existing phones. That's it. The Treo and MS Mobile phones couldn't suddenly do multitouch or run Apple's iPhone photo-editing software.
More crazy is the claim with regard to Philips. Design models as far out as what Philips showed off in 1998 are usually years and years away from production, if they're even meant to. They're like concept cars. And "Came up with the idea for the iPhone?" Touchscreen communication devices of the future were invented in Sci-Fi, not the Netherlands, Rob.
Plus, if you go back far enough, you'll see that Apple had design prototypes of Newton phones back in the mid-90s. For that matter, they also had a model of a device that would translate yankee dollars into Yen. I recommend that Apple sue money-exchanging kiosks at airports. Heck, frog design did an executive phone concept in 1986 for Apple. None of this is new. All of those look more like the iPhone than Philips' bizarre renderings. But hey, if Apple intros an ice cream-buying module? BUSTED BY THE ENDERLE SQUAD!

MacNN reports that the company has been ordered to pay $700,000 to cover the legal fees of a group of bloggers that reported on "Asteroid," a rumored Mac audio break-out box.
"The court's ruling is a victory for journalists of all mediums and a tremendous blow to those firms that believe their stature affords them the right to silence the media," said Kasper Jade, the publisher of AppleInsider.com. "Hopefully, Apple will think twice the next time it considers a campaign to bully the little guy into submission."
Um, maybe, maybe not. I really don't think Apple's intent with Asteroid was to bully the little guys. It was to smother internal leakers. And, given the alternative (can you say HP pre-texting? I knew you could), Apple's tactics weren't that unethical. They were just mean. I'm most excited that the Santa Clara County judge's recognized bloggers as having the same rights as journalists. It's about time.

Sometimes, Apple news gives me tremendous Schadenfreude. Such is the case with word that Verizon chose to turn down Apple's iPhone because the Cupertino Kids wanted a bigger slice of the pie than mobile providers are used to giving up....Sometimes, Apple news gives me tremendous Schadenfreude. "We said no." Said Jim Gerace, a VZW VP. "We have nothing bad to say about the Apple iPhone. We just couldn't reach a deal that was mutually beneficial."
That's an interesting perspective. I hate to laugh, Verizon users (I am, after all, a similarly-shunned-by-Apple T-Mobile user), but this raises an interesting point. Verizon has marketed itself as the home of "The Network," with the best coverage in the U.S.
But without the iPhone, does the Network and the "Hear Me Now?" dude really have your back?
