- DOJ reportedly expands Apple probe

The New York Post is reporting this week that the US Department of Justice (DOJ) is expanding its investigation of Apple in regards to iTunes and changes to the beta iPhone OS 4 SDK.
As for iTunes, Apple is accused of allegedly threatening to withhold their typical promotional activities from labels who continued to offer exclusives to Amazon via their Daily Deals campaign.
Additionally, the DOJ and Federal Trade Commission (FTC) are negotiating which of them will launch an inquiry into a clause in the iPhone OS 4 SDK that bans the porting of software originally written for Adobe's Flash, Sun's Java or Microsoft's Silverlight/Mono to the iPhone OS.
The Post cites "one Hollywood industry source" in their article, so you're free to guess who that might be. In the meantime, we'll follow this story as it develops. Here's hoping justice -- and not sour grapes -- is served.

My wife's iPhone 2G is broken. The power switch always thinks it is being pushed down, which means that the iPhone turns itself off fairly regularly. As you might expect, it's fairly annoying.
Because I have a lot of nice, good, and generous friends, many of whom are also gadget folks, I asked on the Twitter if anyone had an iPhone 2G that was sitting in a drawer after they had upgraded. My friend Jim Ray sent me his. Did I say "friend"? I mean best friend.
I took both iPhones home, swapped the SIM cards, and we all lived happily ever after.
Ha ha! No, not really. Of course it wasn't that easy! As soon as I swapped the SIM cards, the phone showed the "connect to iTunes" logo. When I did that, iTunes said "Hey, congrats! You bought an iPhone! Let's get you setup with a two-year contract with AT&T!" Well, as you may have heard, there are some pretty strong suspicions that a new iPhone is going to be released soon, and the last thing I wanted was a new 2-year contract with a 3 year-old iPhone.

Not satisfied that the magical and revolutionary Apple tablet is helping marine mammals communicate their displeasure with the despoilage of the majestic oceans? Fortunately, the iPad is no unitasker; it's being put to good use in both inner and outer space.
First up, CrunchGear points to this video of Japanese surgeons using the iPad as a display for reference during an operation. The iPad appears to show CT images and possibly a video loop as well; it's covered with a sterile plastic drape. Any translation efforts welcome -- and if other physicians are using the iPad in similar fashion, do let us know.
Second, photographer Scott Audette sent a note to let us know he was able to use the iPad, in combination with some wireless camera control tech from Canon, to manage a remotely positioned camera and capture images of the final scheduled launch of space shuttle Atlantis. Steve Jobs said a lot of interesting things on stage at the D8 conference last night (I'm surprised I haven't seen a t-shirt with "My sex life is pretty good" on it yet), but he did put one issue to rest.
Third-party agencies like Flurry Analytics and others who use iPhone applications to track device traffic were in a tizzy over a recent change to the iPhone SDK's terms of service which disallowed them from sending out device identifier information without the actual user's knowledge. They all figured that Apple was making this change because Jobs and company had their own analytics plan coming, and they were unhappy at being cut out of the action.
But not so, says Jobs -- he just doesn't want information going out without users' knowledge. In his talk last night, he blamed Flurry specifically for logging data from devices inside Apple's campus, and said that wasn't kosher. Maybe Apple will let Flurry do something like that in the future, he admitted, with the user's knowledge and approval, but not right now.
And now Flurry has agreed to comply, says AppleInsider. While the company has been working on strengthening its privacy stance, the CEO agrees that Flurry will back off of sharing the data that Apple doesn't want them to share. Of course, Jobs' statements don't preclude the idea that Apple is looking at implementing its own analytics (he's denied working on phones and tablets at past interviews, and we all know how that worked out), but for now, Flurry is backing down.

Patently Apple has revealed that Apple continues to explore solar power options for recharging its portables, including iPhones and iPads. The latest patent information is intriguing: rather than slapping a solar panel on the back of the device, Apple wants to embed the solar cells below the display. Essentially, there'd be no way to tell from the outside that the solar cells are even present. According to Patently Apple, the design of the next-gen iPhone prototype is suitable for this design, and if the backside of the case is glass or ceramic, Apple could put a double-sided solar cell in the device, potentially doubling the amount of charge it receives from the sun.
The idea of solar power in an iPhone is interesting. I have a Solio charger for mine, and it's great for keeping my iPhone charged on long hikes. I'm skeptical about the utility of having solar cells built into the iPhone itself though, because how often are people going to leave their iPhones sitting unperturbed in direct sunlight for several hours? Perhaps this will be more geared toward prolonging battery life by a small amount rather than being marketed as a full-fledged charging solution. I can see Apple selling this solution as a way to get an extra hour or two of life out of your iPhone every day, but using the sun as the iPhone's only power source will be more difficult, particularly if you live somewhere that doesn't get a whole lot of sunlight.
The concept is fascinating at any rate, and may be something we see in the 2011 models of Apple's portables.

The Google-owned AdMob advertising network wants to make it easier for marketers to leverage the power of iPad (and also stay ahead of Apple's impending iAds frameworks in the process). The company announced today that its iPad App SDK is available for developers; this unified environment works with all iPhone OS devices, so devs can include ad code in apps for iPhone and iPod touch as well.
The tool allows for the creation of text and image ads, but in the near future AdMob expects to provide HTML5 video support -- there's a snazzy preview over on the company blog right now. Video inside advertisements inside applications; whatever will they think of next?
In a side note, the AdMob metrics for iPad are showing that 38% of the devices visible to the ad network's analytics tools (about 850K unique iPads) were being used outside the United States during the month of May. The "Unlimited" plan, including the prepaid iPad version and, eventually, the iPhone postpaid version, is headed towards dodo-ville -- although it's not quite as dead as you might think. I was lucky enough today to have the opportunity to chat with Seth Bloom from AT&T's public relations team. As our Q&A revealed, iPad and iPhone customers will be able to continue using their existing unlimited plans. After Monday, however, the plans will no longer be made available for purchase.

Cats love iPads, dogs love iPads, and dolphins... love iPads? That's the word from a site called SpeakDolphin.com [PDF, here's the text], where researchers say they're using the iPad's touchscreen to offer up visual stimuli for dolphins to touch and interact with. A touchscreen for dolphins needs to have a few certain criteria, including being waterproof-able, sensitivity, and visual clarity, and apparently the iPad fits the bill, as you can see in the picture.
So what kinds of apps does a dolphin use? Turns out they're addicted to Plants vs. Zombies HD, too. No, just kidding -- they use just an image that contains pictures of various items that exist around the dolphin in real life. The trainer points to an object in real life, and then asks the dolphin to point to that same object on the screen, laying the very first groundwork for lingual interaction.
Interesting stuff. We haven't heard of dolphins using Apple's magical device before, obviously, but what's constantly surprising is that the iPad is slowly replacing all sorts of other technology, and being used in many ways that Apple's engineers couldn't even imagine.

Time Inc. has updated the free TIME Mobile iPhone app to version 2.0, building on input from readers of the previous version.
The app interface has undergone a huge redesign and is now much faster than before, answering one of the biggest gripes about the earlier version. TIME Mobile now adds podcasts, the video library is optimized for iPhone viewing, and readers are able to customize which sections of the magazine appear on the app home page.
You can now save articles for offline reading, search for favorite articles, shake the iPhone to refresh articles in a section, and share articles through Facebook and Twitter. As if that's not enough, TIME also made the app more legible by adding the ability to increase the font size for articles or change the font for the entire app.
While it's good to see that TIME has updated the iPhone app, many iPad users are still angry with the magazine's decision to charge $4.99 an issue (through in-app purchase) for the digital version of a magazine that can be had in print for $0.50 an issue. That decision has resulted in close to 74% of all customers giving the free iPad app a poor rating.

Update: We have a full rundown of the changes and AT&T's feedback.
In case you missed it early this morning, AT&T's new mobile data plans (DataPlus, DataPro and Tethering) have given up on the idea of unlimited data in favor of a split tier of 200MB at the low end ($15) and 2GB at the high end ($25), with a $20 supplement for tethering (but hey -- tethering! and only six months late!). There is also a new high-end plan for the iPad, $25 for 2GB as well. In the midst of the ire and anxiety, a few points have been clarified over the past few hours.
If you buy a new iPhone, you are not obligated to accept the new plan terms; existing plans will be grandfathered, according to a post on AT&T's Facebook page. iPad owners can also grandfather in an unlimited plan, although it's not clear what happens if you drop month-to-month coverage.
As pointed out on MacRumors, you can use AT&T's account management tools to check on your own data usage and see which of the new plans is closer to your run rate. You can also just dial *DATA# from your iPhone.

As soon as I tapped my way into MLB At Bat for the Mariners game last night, I couldn't help but notice an ad on the splash page, and other ads on screen on the Game Day desktop.
Until now this innovative iPad app had been ad free, and at U.S. $14.99 a year, that made sense. Major League Baseball isn't exactly going to the poor house, with 6.6 billion dollars in revenues last year. MLB has the right to insert ads in the app, but it seems like a small breach of faith to users.There's more. If you already had the MLB iPhone app, you pay again for the iPad version. And so it goes. A nickel here, a dime there.
We've heard this song before. Premium apps that start ad-free, and then sneak in the ads once they build up a following. Another example is the CNN app, which is $1.99, and includes ads. Some people resent paying for the ads, others don't care.
What's your take? Do the ads on At Bat bother you, or are they no big deal? Do you want the option to buy a premium app with no ads?

Business Insider has a post up from AdAge about magazine pricing on the iPad, and they've got bad news for anyone planning to transfer all of their magazine subscriptions to Apple's magical device: It'll cost ya. While a year's worth of Popular Mechanics goes for $12 from the publication's website (or even cheaper if you can pick it up from Amazon or that random kid wandering your subdivision selling subscriptions), the iPad subscription will cost $29.95; that's over twice as much. You can buy a year's worth of Wired on Amazon for just $10, but one issue on the iPad costs you half of that.
Why? At first, the cost seems like a ripoff; publishers don't have to pay for paper, ink, or postage, so you'd think the content should actually be cheaper. Then you calculate in the cost of interactive designs and features, researching new technologies, and creating new workflows, and creating an iPad version of the magazine starts to get more expensive. Throw in that publishers are wary of pricing their content too low, and you get a higher price than a print subscription -- which plenty of readers will probably pay anyway.
That's a pretty fragile pricing state, though; e-books are already cheaper than their print versions, and while comic books are the same price in the store as they are on something like the Marvel application, you have to think that those prices will drop too. John Battelle's Searchblog has an interesting post up about whether or not the iPad can be categorized as a disappointment. He begins with a mea culpa; while he predicted earlier this year that the iPad would more or less fail, the sales figures from earlier this week have proven him wrong. However, he says that the question then turns to whether the iPad will be a disappoint in its larger goal: to revolutionize computing and use the App Store model as a replacement for the usual download-and-install app method that we currently use on desktops.
Battelle says that the iPad is doing what AOL (disclaimer: TUAW is part of Weblogs, Inc., a division of AOL) did back in the early days of the Web: distilling it into an easily consumable form. Just like AOL created a portal for Web browsing, the iPad creates a portal for content consumption, all through Apple's App Store (and through Apple's "approved" Web, depending on whether you think Flash's approval is a bug or a feature).
Battelle also says that Apple's portal comes with the same issues that AOL's portal did; AOL, he says (and I presume he means the old AOL, not the one paying me to write this), was killed by the link, and the iPad, as he sees it, will eventually be killed by whatever links apps together. AOL was a "walled garden" of their content, and as long as Apple maintains its grip on the App Store, it's that same garden; each app works within its own flower pot, almost completely independent of the others.

This wild little graph was derived from recent data that was provided by Net Applications (the same data that provided those iPhone stats earlier today). The iPad's Internet traffic has been growing by leaps and bounds on the weekends. As you can see above, over weekend periods since launch, iPad traffic almost doubles, and then it drops back down again during the week. Last weekend was the international release, which resulted in that last big jump. However, I wouldn't be surprised to see traffic drop back down, even if not as much, this coming week.
That's one of the weirdest usage patterns I've seen, but it makes sense; people are coming home on the weekends and using their iPads while away from their usual work and home computers. When they go out on the weekend to relax, they're taking the iPad with them, and most interestingly, they're "learning" to use the iPad; you can see steady growth in usage during the week and more usage on the weekends.
That's a fascinating little packet of data about a fascinating new kind of computer.

I got to play with Pocket Creatures back at GDC earlier this year, and the app is now out in the App Store. The game turned out well -- you oversee a tiny creature with various needs and attitudes, placed on a small tropical island full of various things to find and combine and play with. The game is super low pressure -- there are items to find and collect, and small tablets in the game push you along a bit, but you can explore and experiment at your own pace just for fun. The game's already gotten a 1.1 update with lots of ninja-based accessories and toys, and we can probably lots more free updates to come.
The game is $2.99, but with almost endless possibilities to explore and more content to come, it's an excellent buy. I haven't seen it running on the iPad yet, but I bet it looks even better over there. You've got an iPad. You've got a Bluetooth keyboard that you love. Now imagine this: You're in bed. Your keyboard is somewhere downstairs. And yet, it's still in range and paired to your device. You can tap, tap, tap in the iPad Spotlight text entry field, but there's no keyboard for you to use. Frustrating, no?
Sure, you can hop over to Settings and globally disable Bluetooth. But there has got to be a better/easier way to recover the on-screen keyboard without messing with Bluetooth, right? There is -- but it's only available right now if you're a developer (sign it using your credentials) or using a jailbroken system.
I've posted a little utility, which I call KeysPlease over on my website (direct application link) and on the ModMyI repository (thanks, Kyle!). I've added it to my iPad dock, and now when I'm in the wrong room I just tap the app icon to retrieve my soft keyboard. Bluetooth remains unaffected and I can keep working on whatever I've been working on.

Well, it was too good to last. To the wailing and gnashing of teeth, AT&T has given the ax to the unlimited data plans for iPad and iPhone customers. AT&T announced two new data plans -- priced at $15 and $25 each -- with the cap on the higher-end plan set at 2GB per month. If you want tethering on top of this, you have to fork over an additional $20 when iPhone 4.0 arrives, most likely at WWDC.
It's been a little over four months since the initial data plans for the iPad were announced, and slightly more than a month since the 3G iPad's been available. So, why the rapid about-face? It probably has something to do with the more than 2 million iPads sold to date, and the iPhone's increasing global share. This is most likely overwhelming an already-stressed data network, even though AT&T insisted that they could handle it.
Currently unlimited data plans for existing iPhone and iPad customers are still in effect. However, once contract renewals come up, don't be surprised if you have to wave bye-bye to unlimited data. The press release did not say if the $20 tethering option would be available to those who decide to keep their unlimited data for now, but MacRumors believes tethering won't be available unless you're on the 2 GB "DataPro" plan. Unfortunately, they're probably right.
