- Apple wins appeal over iPod hearing loss

The Ninth Circuit Court of Appeals has affirmed a 2008 ruling dismissing a 2006 case brought against Apple, which claimed that the iPod music player caused hearing loss.
In the original suit, a Louisiana man had claimed that the iPod had the potential to cause irreparable hearing loss, citing the design of the ear buds as encouraging too-deep placement within the ear, and the lack of volume meters.
He had sought to have the suit classified as a class action suit against Apple, but in 2008, the District Court for the Northern District of California dismissed the suit, agreeing with Apple's assertion that the design did not cause an unreasonable risk of noise-induced hearing loss. The judge stated that the lawsuit had merely pointed out ways to make the device safer, not shown that the device itself was dangerous.

Billings, my personal favorite time-tracking, estimating and invoicing application has just updated to version 3.5. The developers, Marketcircle, are labeling it the "Trojan" release due to its mostly-under-the-hood improvements. Under the hood, but not insignificant. The major changes are related to a database engine overhaul (subtly continuing the car metaphor for your reading pleasure) and improvements to the way Billings interfaces with Address Book. Rest assured that "Trojan" refers only to the nature of the updates, not to any kind of malicious software).
I'm certain that those covert improvements, while exciting for current users, probably won't be enough to stir the passions of others. The fact that Billings 3.5 is now able to sync over WiFi with your iPhone might be cause for celebration... if only we had a version of Billings on those clever devices. Fear not, Billings Touch has been submitted to the App Store and is nearing availability as you read this. As a beta tester, I can't talk about the features of Billings Touch, but I think it's all right to tell you that it's everything I'd hoped it would be when AJ first mentioned it.

While no one was looking, the Apple iWork suite jumped 50% in sales this year over 2008 levels. The retail sales analysts at the NPD Group say much of the current popularity of the program stem from the sales of Snow Leopard, which bundled the productivity apps for U.S. $169.00 for a single-user version and $229.00 for a family set.
AppleInsider quotes Steven Baker, NPD's V.P. of industry analysis, saying "These have been, I think, pretty successful products for them (Apple), generating a lot of pretty decent average selling prices and decent revenue numbers."
I really like the iWork apps. My last book was mostly written on Pages, then sent off to the publisher as an RTF formatted file. Keynote is very powerful, and doesn't have the tired old look of PowerPoint.
Apple is apparently working on moving a good deal of iWork to the cloud, and Microsoft is taking the same path with Office.

Touch Arcade has word that one of 2008's best iPhone games (our 2009 list is coming out this week), Fieldrunners [iTunes link, $2.99], has released an update (1.3), in which they've released two new maps available as in-app purchases, and they've included OpenFeint 2.4 functionality, with messaging, chat, and everything else the in-game social network portends.
The two new maps are called Skyway and Frostbite. Skyway boasts a metal floor with a few holes in it, which limit where you can place your units in the tower defense classic. Frostbite is a snowfield with a base in the middle to defend from attackers on all sides. Seems like both offer up some interesting twists on the gameplay -- they're 99 cents each (a fact that has the most recent iTunes reviews up in arms), but if you ask us, two bucks for new content is cheap, especially if you're a big Fieldrunners fan already.

Apple makes it clear: when applications rely on network connectivity, they must always test for a valid connection and report those results to the user. If the app cannot reach the Internet, the user needs to know. App Store reviewers regularly reject applications that do not test, and when a connection is not found, report that the network cannot be accessed.
Developers need to integrate this process into their apps. If your app connects to a server, for example, it must test the current iPhone configuration and report to the user whenever the network cannot be reached. Apple provides sample code to help with this.
iPhone developer Andrew Donoho was not particularly impressed by Apple's sample reachability code. So he decided to do something about it. He has created an open source, BSD-licensed update, which he posted on his website. His updated reachability utilities fix a few Apple misspellings and tunes up the code, allowing you to revert to the original implementation via compiler flags.
You can easily download his update and integrate it into your iPhone applications. His write-up describes the testing process and offers an implementation process for successive network tests. You build your decision tree and user feedback off the results of each test. Donoho has provided this code to allow others to build off his work without having to re-invent the entire process from Apple's original source.
If you're interested in a slightly different take on reachability, you might also want to take a peek at my UIDevice Extension category, which provides a number of other approaches to Reachability checks. Among other features, the category includes a WiFi check and hooks that allow you to change reachability status from within your application. Google China's former head has posted what appears to be insider details about the (possibly) upcoming Apple tablet device. According to Gadget Mix, Kaifu Lee blogs that "an informed friend" told him the Apple tablet looks like a larger scale iPhone with "an awesome UI packed in a beautiful 10.1-inch screen."

Our sister site, Engadget, unveiled its iPhone app [iTunes link] today. The free app functions in the same way as the current TUAW app [iTunes link] by delivering a constant stream of news from the site. Engadget's app will cover news from the main site, Engadget Mobile and Engadget HD.
Among the app's features are sharing articles through Twitter, Facebook or e-mail, the ability to tip Engadget on breaking news, and the ability to bookmark and view articles offline. I'm an avid user of Xmarks (formerly Foxmarks) as are probably many of you. I browse the Internet regularly on three different computers, and so it helps immensely to have all of my Firefox bookmarks and passwords synced. But the one fly in my ointment has been my iPhone's mobile Safari installation -- because I don't usually use Safari as my browser, I haven't yet figured out a way to get all of my usual bookmarks on to the iPhone.
Until now: this writeup by Shawn0 (via the good folks at Lifehacker) presents a quick workaround to get your Xmarks-synced bookmarks up and running on your iPhone. Unfortunately, he uses Internet Explorer to do it, but given that we're all on Macs, I discovered that it worked just fine with Safari. Set up Xmarks on your Safari installation, sync it up with your usual bookmarks, and then set iTunes to sync your mobile browser's bookmarks with Safari. The one big drawback is that you'll have to start up Safari every once in a while to make sure your changes get all the way out to the mobile device, but that's better than not having them synced up at all.
And yes, you MobileMe users are laughing at us Xmarks users right now, because Apple's service syncs all of these things automatically. But I've never known Xmarks to go down, and this solution costs the low, low price of free per year. Das Cube [iTunes link, $1.99] is a simple little iPhone game that comes with a pretty impressive pedigree: it's made by one of the creators of Aquaria, Mark Johns of Space Barnacle, and features music by the composer of Canabalt's crazy addictive soundtrack. As you can see in the video above, it's got more in common with the iPhone post-apocalyptic running simulator than the underwater adventure: your job is to move a little ball that can smash together a series of abstract shapes that then explode into points. That's pretty much it -- as the game gets tougher (there are two difficulty settings, though I found the "Brutal" setting to be only a little tougher than the "Easy" setting in the first few minutes), more blocks drop, and while you can shake the iPhone occasionally to help you clear the screen, if you go too long without matching pieces, your game is over and the high scores are calculated.
It's not quite as simple or addictive as Canabalt -- the controls feel a little floaty, and sometimes the ball you push around will squeeze in between the blocks. A few times while playing, it seemed to me that the easiest way to win would be to just swirl the mix around, and sure enough, when I just rolled the ball around the screen, I eventually got blocks to crash together randomly. But by the time I hit around 60,000 points or so (you can tweet your high scores, just like Canabalt), I found a little more precision was required, but even then, the controls are anything but sharp.
Still, Das Cube is an amusing little mix of music and graphics. Unfortunately, there's no free trial, but what you see above is what you get: smash shapes together to groovy techno tunes. Things started off looking grim for the iPhone when it went on sale in China in October of this year with sales of only 5000 phones in the first week. Forty days after the initial launch however, China Unicom reported they sold 100,000 iPhones. Now, just twenty days after that 100,000 mark, Dan Butterfield over at iPhonAsia.com is reporting a surge of iPhone sales equaling 200,000 in the last three weeks. That brings China Unicom's iPhone sales to 300,000. in just two months.
This really isn't surprising considering the massive popularity of the iPhone with some of China's neighbors and another pretty big country.
It also looks like China Unicom is putting their money where their mouth is when they said "iPhone will become China's best-selling smartphone." This week they've kicked off a 46-city roadshow tour to promote the iPhone to prospective buyers across the country.

LinkedIn has always seemed like the "me too" of social networks, in my mind. They started out as a site more about careers and job networking, but with the big growth of Facebook the last two years, it seems like they're working as hard as they can just to keep up with what's going on over there. And that seems to be the case with their updated iPhone app as well, just released on the App Store [iTunes link, free]. There's a lot of new features, but as TechCrunch's MG Siegler points out, they're very similar to what's already in the great Facebook app: a revamped UI, the ability to comment on status updates, share pictures, and so on.
The power of LinkedIn, if you ask me, is in its demographic -- Facebook is where I share with my family and friends, and LinkedIn seems to be where I have connected with coworkers and colleagues. And they hint at that a little bit in this release: there's a feature where you can share contacts across Bluetooth, which seems like a good idea for the upcoming convention season (sounds like the same kind of functionality as Bump). But most of this stuff is just more "me, too." Instead of sharing photos and status updates with my work acquaintances, how about some more functionality exclusive to just them?
Of course, even more than demographics, the thing that matters most about social networks is how many contacts you actually have on them.
