- French courts require foreign vendors to remind customers about 'iPod tax'

A French court has ruled that online retailers shipping music players to addresses in France must warn the customer that they will have to pay the "iPod tax" once the device arrives in the country.
France enacted a levy designed to compensate copyright holders to the tune of €40 per device for illegal file copying. French retailers roll the levy into their price, making vendors outside France more attractive, price-wise. The levy applies to music players, USB storage, and blank media.
While the warning is now necessary, it's no guarantee that the tax will be paid.
Other countries have considered a similar tax: the UK, Canada and Japan have all considered a similar fee, but all have failed for one reason or another.

When the concepts of "antivirus" and "Mac OS X" approach each other in the blogosphere, the usual outcome is more heat than light. The current example of keyboards outpacing brainwaves has emerged from a storm of posts on various sites, mostly tracing back to security analyst/Washington Post writer Brian Krebs and AppleInsider's Aidan Malley. Both pointed to a "recently published" Apple KB article that listed a trio of AV applications available for Mac OS X.
More shocking to this pair of pundits: the KB article actually went so far as to encourage Mac users to buy, install and use antivirus software -- even "multiple antivirus utilities" to prevent the spread of malware, which was trumpeted by a ZDnet headline. What now? Is Apple's security story on the marketing front now undermined by the quiet truthtelling of the support site? Should Justin Long apologize to John Hodgman? Are cats and dogs now living together? Is the BBC picking up the story (yes, unfortunately, it is)?
The relevant quote from the shiny new KB article that has caused such commotion:
Apple encourages the widespread use of multiple antivirus utilities so that virus programmers have more than one program to circumvent, thus making the whole virus writing process more difficult.
Let's be fair: Apple's prose isn't helping matters, because while we all know that "widespread use of multiple antivirus utilities" doesn't mean you should be installing multiple AV tools on your one, single Mac -- the point is that the ecosystem should have variation, making it harder for malware writers to attack the entire population with one well-crafted vulnerability -- that fine distinction appears to have been lost on some of those who encountered this "new" KB article.
This, of course, brings us to point #2: a careful reading (or really, any reading at all) of the KB item shows the "Old article: 4454" legend at the top right. Yes, Apple does sometimes update KB articles, and in this case the same exact "multiple utilities" copy has been on the support site for a while -- the article was originally published in June of 2007, and was updated simply to reflect current versioning on the Intego and Symantec AV products.
So, to sum up, Apple's recommendations have changed not a whit in 18 months. Everyone who is decrying the sad state of security on the Mac -- or, conversely, crediting Apple for waking up and smelling the coffee -- is chasing his or her cybertail with a great deal of enthusiasm. Malware on the Mac, such as there is, is still almost exclusively delivered via social engineering, so please don't install random video codecs downloaded from porn sites. That said, the commercial and free AV options for the Mac are pretty stable, and they're certainly worth exploring if you want to be a good computing citizen who doesn't relay Windows malware from friend to friend unknowingly. Read on for my top five tips when/if installing AV tools on your Mac.

In yet another new facet to this already-draining legal battle surrounding Psystar's sales of non-Apple hardware that runs Mac OS X, Apple has amended its original suit after it discovered "additional information," according to Computerworld.
Apple now claims Psystar circumvented Apple's copyright protection code, in violation of the Digital Millennium Copyright Act. Apple said in its original filing that Psystar was in violation of the Mac OS X End-User License Agreement, but tacked on this additional charge last week.
The amendment also names 10 "John Does" -- persons who were not part of the Psystar company, but broke the copyright protection scheme. Apple doesn't know who they are yet, but plans to name names when its lawyers find out who they are.
In other Apple legal news, Apple won a trademark infringement case in China against New Apple Concept Digital Technology Co., Ltd., based in Shenzen. Judges decided that the Chinese company had a logo too similar to Apple's. New Ap -- aw, eff it -- NACDTCL was ordered to pay 400,000 yuan (≈ US$58,000) to Apple, Inc.

We were recently wondering what happened to the in-ear headphones that Apple promised way back in September. Today, we're happy to see that the online Apple Store is finally offering them for sale with free shipping and delivery listed as 7-10 days.
These headphones promise to be of higher quality than the standard buds that ship with the iPhone. In addition to better drivers and sound isolation they include the new combo mic / remote that offers volume control on certain late model iPods (basically, the presently shipping models only). Sure, you could update your Apple software by opening Software Update from the Apple menu. But what if you're inclined to use a command line interface, or maybe you need to update a remote machine via SSH? There's a way to complete a software update in Terminal.app. Here's how.
If you want to do an automatic install of all the updates for your particular Mac, first log in as an administrative user. Then open Terminal.app (located in /Applications/Utilities), and type (or copy/paste) the following command:
sudo softwareupdate -i -a
and hit Return. Next, you'll be prompted to enter your password; do so, and then hit Return. The application will then look for available updates, download them, and then install them. You will see the progress in Terminal. If no updates are available, Terminal will let you know.
This command replicates the functionality of the normal Software Update utility. However, you can use it on other machines in the background via SSH remote login, or you could apply a specific update rather than the full list of available patches. To see all the command options, typeman softwareupdate
at the Terminal prompt.

Fearless TUAW blogger and all-around nice guy Brett Terpstra wrote about Yazsoft's ShareTool in a Friday Favorite post a couple of weeks ago. Just to review, ShareTool allows you to easily access your Bonjour services on a remote machine as if you were still on your home network -- iPhoto and iTunes sharing, printer access, just about everything you could do if you were sitting at your kitchen table with your laptop.
Version 1.2.5, announced yesterday, has some key new features:
- ShareTool automatically configures routers supporting NAT-PMP or UPnP
- Remote services automatically appear in Finder, iTunes, and other applications
- ShareTool enables remote access for any application or service that advertises itself using Bonjour and runs over TCP/IP
- All network traffic is strongly encrypted. Access to your services requires your Mac OS X username and password

Joost, the on-demand video streaming service that came to the Mac a while ago, has now made its way to the iPhone and iPod touch. The video service features music videos, TV shows, and even movies ... and you can now watch all of them on the go.
You can browse videos by Joost picks, popular videos, browse videos by category, and search for videos. Joost uses a custom built video viewer, as opposed to the regular video player that is used by the YouTube application. I didn't really like this custom view, nor the inability to rotate the video. I also had some troubles trying to watch a video; sometimes I would be presented with a "Playback Error." When I was able to view a video, it stuttered all the way through to the end.
The Joost application is a great start for the video on-demand service, but I would like to see tighter integration with the Joost platform. Right now, this application just seems like an alternative to the YouTube application that's already built into the device. If you are a Joost addict, however, you might want to check this application out. While this might not meet the official definition of an "Easter Egg" in an application, I thought it was pretty cool that when I opened Flick Bowling (click opens iTunes) on December 1st, I noticed something different.
First, the background on the splash screen (below) was red instead of the normal blue. The "Flick" logo is in Christmas red and green, and the bowling pins now have red and green stripes.
When you bring up the Free Play mode and start bowling, you'll notice that the usual bunting at the end of the alleys is now supplemented with Christmas lights and a big wreath (see screenshots below).

Although the plumbing has been in place since the summer, it's always nice to have an official announcement, and now we do: Google has gone on the record with its support for CalDAV syncing from iCal to Google Calendar. You can now gracefully sync your editable Google calendars with your (Leopard-only) iCal, keeping a local copy of those events in the cloud.
Granted, both BusySync (which adds Bonjour-based iCal synchronization between Macs) and SpanningSync (which includes Address Book --> Google contact sync) have been handling this task with aplomb for some time, and they offer something Google hasn't -- a nice GUI for picking your sync options. That too has been addressed: Google Code is hosting the Calaboration sync setup tool, a basic checklist of calendars to add to your iCal setup.

Apple 2.0's Philip Elmer-DeWitt notes some new Net Applications statistics that suggest 8.87 percent of all Internet users use a Mac: a new record.
Add to that the iPhone platform's 0.37 percent, and over one in eleven use an Apple product to browse the web. The iPhone gained 12 percent more users compared to the month before.
Also notable is that Windows users accounted for less than 90 percent of Internet users for the first time in recent memory. Also, market share for Internet Explorer dropped below 70 percent for the first time since its popularity surged in the late 90s.
Linux also gained ground, increasing almost 17 percent to 0.83 percent of all Internet users.
Net Applications tracks statistics from over 160 million visits to websites it monitors. The full report is here.

The good folks at Pixelmator have released version 1.3.1 of their lightweight and smooth photo editing software. While the update is mostly "bug fixes and minor improvements" (isn't that exciting, unless maybe you really were waiting for "iSigh support" -- which probably means iSight), but there are two big changes: the Color Management panel has been updated (as you can see above), and the Refine Selection tool has a very nice, real-time masked UI that lets you see exactly which parts of your selection are being feathered or smoothed out.
Definitely not as big an update as the 1.3 Tempo that we posted about a while ago (although 1.4 Sparkle, we're told, is being worked on right now), but it is free to all users, and in fact ready to download right now in Pixelmator. The DVD costs $19.84. Cute.
Billed as "the first documentary of its kind," the film explores the early years at Apple through interviews with observers and former employees of the company, such as Guy Kawasaki, Andy Hertzfeld, Ron Wayne, John Moltz, and Leander Kahney.
The DVD has three additional hours of footage beyond the 83-minute movie. Quantities, according to the official site, are limited, and orders will ship mid-December.

Apple met or beat analyst expectations for sales over the weekend, selling 13 Macs and 3.4 iPhones every hour, according to one Piper Jaffray estimate.
Kaufman Bros. analyst Shaw Wu said that Apple's Black Friday promotions helped drive retail store traffic, according to reports from distributors. Wu also noted that the iPod touch is sold out at Amazon.com, which leads him to believe that Apple could sell $10 billion worth of products this quarter.
Thomas Weisel Partners' Doug Reid got the impression that Apple sales were up from last year. He was less optimistic about Dell's retail performance at Best Buy locations, noting that salespeople there were not strongly recommending Dell models at 35 stores they checked.
Weisel analysts expect Apple to sell 2.4 million Macs during the fourth quarter.
Deutsche Bank analysts also conducted their own checks over the weekend, and found demand to be "solid," considering the current global economic woes. They expect Apple to sell 5 million iPhones this quarter, and reiterated their "buy" rating and price target of $150 per share.
AAPL was down slightly in morning trading.

For those of you sickened by the commercialism and resulting chaos of the holiday season, here's an idea to make you appreciate the holidays again: follow the concept of paying it forward.
The concept is easy to understand: someone does you a favor, and instead of paying them back, they ask you to do something good for others. I'd like to ask TUAW readers to help take part in a "pay it forward" project. Let me start by telling you about my project this year.
In this case, I feel like the good people in the Denver metro area have done me a favor by helping my Mac consulting business, Raven Solutions, LLC, become a success. Earlier in the month, I received a phone call from a local non-profit called Art from Ashes wondering if I could provide some assistance with Marketcircle's Daylite application. As Dave and Mike discussed during last night's talkcast, Sunday's episode of The Simpsons included plenty of wink-wink-nudge-nudge references to our favorite fruit company. (The video is also available on Hulu.com.)
Lisa discovers a "Mapple store" has appeared in the Springfield Mall, complete with "myPods," "myPhones," and even a "Brainiac Bar." Comic Book Guy wants to know why OS 4.2 is built so poorly, and Krusty the Klown wants to get rid of his myPod.
Mapple CEO "Steve Mobbs" also makes an appearance, with typical Simpsons hilarity ensuing. While not particularly biting social commentary, the sketch pokes fun at
AppleMapple customers' willingness to shell out big bucks for their products.The Simpsons have taken on Apple before, with the now-famous Newton "eat up Martha" gag. You might say this is one more thing to add to the list of gags that The Simpsons have done. In the words of Steve Mobbs and Steve Jobs, it's "insanely great."

Al Diblasi over at Alfred.TV keeps coming up with fun videos with old Apple or related devices as the centerpiece. In this latest 53-minute masterpiece on YouTube (below), Al boots up a 1991 68040-based NeXT Cube, and then shows off some of the built-in applications, an original brochure for the NeXT, a cool NeXT black turtleneck (Steve Jobs' influence, obviously), and a couple of versions of the NeXTstep OS and development environment.
For those of you who are new to the Mac world, NeXT was the company Steve Jobs founded after being kicked out of Apple. Originally, they produced both hardware, of which this NeXT Cube is a prime example, and software. NeXT was purchased by Apple in 1997, and the NeXTstep environment evolved into what we now know as Mac OS X and the Cocoa development suite. A NeXT computer used by Tim Berners-Lee was the world's first Web server.

This seems pointless and yet brilliant at the same time, somehow -- iPhone Savior has concept pictures of the iPod shuffle extended out into a bracelet. You can already find lots of straps and wristbands for the shuffle, and with that clip on it, it's designed to be jewelry anyway, so why not carry the premise out to its conclusion, right?
It's almost perfect, and yet weird enough that Apple would never go for it -- they'd much rather make the hardware, and leave the straps and hooks to third-party vendors, I think. Still, it's an interesting idea. What other kinds of jewelry could include the smallest version of "the world's most wearable" mp3 player? A shuffle necklace? Shuffle earrings?

I'm not exactly sure why there's so much excitement centered around the upcoming Greensboro Apple Store (my guess is it's because our friend Ged of the Iconfactory can't wait for it to open), but the excitement is there, and Ed Cone has some insight into how the store's deal got put together. Apparently Greensboro won't see the story by December 25th, as there's apparently some argument with the property's owners over whether Apple is "just another computer store" or deserves a better place in the location. You know our answer on that one.
An anonymous reader also tells Ed that the store's construction cost a pretty penny -- $1.7 million for 5,873 square feet, according to the building permit. Unfortunately, we're not sure if that's more expensive than usual or not: most retail places seem to cost a little less according to this, but then again, $1.6 million per store for Apple is about right, according to past numbers.

Wow, it seems like only a few weeks ago our very own Mike Schramm was telling us about Flick Fishing, a new fishing simulation game from Freeverse. They've let us know that version 1.2 of this great game will be available soon in the App Store (click opens iTunes - note that version 1.2 may not be available yet).
What goodies did Freeverse pack into the latest incarnation of this US$0.99 bargain? The list is extensive:
- New fish
- New locations
- Quest modes
- Fishing tournaments
- Easter eggs!

If you're looking for a quick "pick up and play game," give iHangman a try? iHangman [iTunes link] allows you to play the timeless game of hangman right on your iPhone.
In iHangman, you pick letters from the side to make a word. If you don't get the word after a couple tries, then you complete the hangman and lose the game. However, if you guess the word, then you win. iHangman gives you plenty of options in the Settings tab -- you can change the timer, have single or multiple players, see the leader board for your iPhone, turn sounds on/off, and choose the word list categories. You have the option to choose from a myriad of word lists including: Animals, countries, sports, SAT, GRE, Science, and more.
This game includes over 36,000 words and their definitions. That's right ... definitions! When you lose or win a game, you are presented with the full word; when you shake your iPhone side-to-side, you will see the definition of the word. This is a very nice feature. Overall, iHangman is a fun game to play, and at $0.99US, it's not very expensive.
